It is better to earn the right to lock your buyers into a contract than force them to commit without even giving them a chance to choose you. don't waste your time with people that will not match the same commitment you give your clients. Make things official and then work extra hard when you get the contract signed.

Buyer Agency Agreements are where a Realtor represents the buyer of real estate. With the advent of "Buyer Agency" (Buyer Brokerage) in the early 1990s as opposed to seller agency, a real estate Agent/Broker agrees and contracts to represent the Buyer in her purchase of a home/property. Buyer Agency Agreements were developed to set out the terms and conditions of this representation. They are similar to the written "Listing Agreements", required between Listing Agents and Sellers (property owners). Buyer Agency Agreements set out the main conditions of the relationship between the Buyer Agent and her Buyer Client including such things as the duration of the agreement, the commission to be earned/paid, and the various rights, duties and obligations of the parties. The Buyer Agent owes fiduciary duties to the Buyer under this relationship and agreement, including fidelity, honesty, dedication to purpose, acting in the Buyer's best interests, etc. The commission to be paid to the Buyer's Agent in the Buyer Agency Agreement, though ultimately the Buyer's obligation, is generally offset in whole or in part against the share, or "co-op", commission offered by the Listing Agent through the Multiple Listing Service ("MLS"). An exclusive buyer agent is a real estate agent who works for a company that does not ever represent sellers in real estate transactions. Exclusive buyer agents (and their clients) avoid the conflict of interest of working with an agent who promotes their listings or their firm's listings. It is beneficial to a buyer to have representation because the agent is responsible for acquiring information on the property and advising the buyer based on that information. Without an agreement, the agent may not have an obligation to work with the buyer's best interests in mind. A Realtor that is acting as a Buyer's Agent has a significant economic conflict of interest if their commission is split with the Seller's Agent, as in most real estate transactions. Because a commissioned Buyer's Agent is paid more if the Buyer pays more money, the Buyer's Agent has a direct economic incentive to make the Buyer pay more for a property.

A couple of things I wanted to cover for you and quiet possibly save you a lot of money this week is when you are filling out the Buyer Broker Agency agreement please note that the date that you fill in at the top is not todays date it is the “Expiration” date of the agreement. Ouch that can hurt if you fill it out incorrectly. Also, the commission portion I recommend filling it out at 3% +$350. This section should be read carefully as it is meant to cover you in a couple of ways. Let’s say you see a BAC of 2.5%, then your buyer is subject to the .5% difference + $350. The $350 is used to pay your transaction coordinator if you use one. Hope these tips help you out!

The buyer's exclusive agency agreement must be specific as to what you are doing, and must be signed by both parties to make sure you comply with the statute of frauds, and any other state-specific statutes that might be in effect. Attorney Steve discusses one Arizona case where the real estate broker failed to sign their copy of the agreement, and the commission, which might have been high five figures or even six figures, was lost due to this minor technical difficulty, showing once again that when the Court look at the real estate versus the home buyer when analyzing the right to a commission, things can often be strictly construed against the agent. So this makes it all the more important that the agent understand the rules and make sure they have taken every precaution to protect their commission. Hope you enjoy this video. A buyer broker agreement confirms a commitment between buyer and broker (real estate agent) to work together. This tells the agent that you are counting on them and are not working with other agents, which in turn means that the agent should put more effort into personalizing their service to you. This agreement also shows the buyer that the agent has certain responsibilities to their buyer and should be expected to live up to these. All my clients sign buyer broker agreements and while you can get out of the agreement, no one has ever wanted to. Its another form that shows a level of professionalism in the service your agent should provide.
