For example -- especially in the light of the 2012 London Olympics, consider contributor Steve McNicol's 'Muckle two lengths' article, which, focusing on the story of Olympic swimmer Chris Cook, reveals one instance of how business can be linked with sport. Chris focused on a single objective; which was not winning medals, but merely swimming two lengths of the pool as fast as he could. Obviously, as McNicol (Muckle LLP's managing partner) admits, this oversimplifies the process by which Chris achieved his medals, but the basic principle is certainly pertinent to motivational HR in most lines of business, including law. Any HR strategy, including this one should ideally be designed with similar simplicity and with a key objective in mind. The details of how this can work in the context of a law practice are further explained in this book. The book's four-part structure includes a review of management tools and principles that drive winning strategies, together with a discussion of the strategic issues that face law firms, including people issues, knowledge management and financial management. And, as example is often the best form of instruction, there are some rather fascinating case studies that demonstrate by illustration and anecdote how the strategic planning process actually works. Author John Sterling, an expert in strategic planning, assures us that the principles and practices described are applicable equally to large, mid-size and boutique law firms, Within the UK context, we would also add that the book is a useful source of consultancy for firms of solicitors with international links and directly adaptable to the needs and aspirations of sets of chambers. Indeed, with business having gone global, this 'roadmap' would be useful for just about any law firm anywhere, particularly firms specializing in commercial law. Alright, this is obviously a much bigger conversation than we have time for in just a few minutes so I'm just going to tell you Step Number 1, the A plus number one don't fuck this up step for your strategic plan. Here's what you do. You call a meeting of your shareholders; those are your family, your husband or your wife or your grown kids or whoever has a vested interested in the success of your business. You call a meeting of those people and you say, where do we want this business to take us in the next 36, 48, 60 months? Don’t worry about ten years. Go two years, three years, four years at most, don’t go that much further than that. Where and how do we want to be living our life? Don't worry about how much it costs, don’t do that, don’t make that mistake, how do we want to be living our lives? What kind of house do we want to be living in, what area do we want to be living in? What kind of vacations do we want to be taking? What kind of insurance do we want to provide for our children and our future? What kind of domestic help do we want to employ? How many hours do we want to be giving the business in the average week? Some weeks will be more, some weeks will be less, but on average how many hours do we want to be giving to this business so that the business gives us the life that we want to live because your law firm should be a vehicle that gives you the life you want to live. Your law firm should be working for you. Your life shouldn't be all about you working for your law firm. So Step Number 1, I promise you this is the foundation, this is what makes the difference. Call the meeting of your shareholders and talk about how do we want to be living our life? And what does the law firm need to accomplish not some fairy tale pie in the sky, we need to win a gigantic judgment or settlement or whatever lottery ticket strategy. What does the law firm need to accomplish? How much predictable revenue does a law firm need to produce for us every month, every quarter, every year? What kind of support staff, what kind of systems, what kind of procedures do we need to have in place so that we're not coming home miserable and burnt out and grouchy and stressed out about the law firm. And what kind of business do we want to have? You know, if you get off on helping people get out of unhappy relationships so they can start a new life then don’t go and be a personal injury lawyer just because someone you went to law school with makes a bunch of money as a personal injury lawyer. Happy lawyers make more money. You don’t make a bunch of money doing stuff that doesn’t turn you on and excite you and then suddenly make you happy. You'll never be able to muster the stick-to-itiveness and the commitment if you don't – if there isn't something about the work that really excites you and I just use family law and personal injury because it was the first example. I could use a thousand different examples that we've seen where lawyers go and try and chase the buck rather than building a firm that makes them happy. So Step Number 1 on building your strategic plan is a meeting of the shareholders, that’s your family, those are the people who are financially invested in your business. They give you access to financial resources to invest in your business. They give you access to emotional resources to invest in your business. They give you access to their time and their patience because they've got to listen to you everyday when you come home complaining about what's going on in your business. They're your shareholders, they're your investors. You know what we call it? In law there's a cause of action. We all know this cause of action when you take assets and resources that are entrusted to you by your shareholders and you misappropriate them. It's called embezzlement, don't be a financial emotional embezzler of your families resources. Involve them in your strategic plan because it's their strategic plan. The rest of it is very, very simple to do; it's mechanical, it's predictable, lawyers have been doing this for hundreds of years, you can do it too.

July 16-31, 2015 – International consultant on strategic planning and management of court systems, Kathryn Harrison, is visiting Tashkent within the framework of the research component of the “Rule of Law Partnership in Uzbekistan” project. The goal of the mission is to study the existing mechanism of evaluation of courts’ performance in Uzbekistan; based on the international experience introduce best-practice methodologies and approaches to improve the evaluation system, including the development of methodology of civil courts’ user satisfaction survey. “Rule of Law Partnership in Uzbekistan” is a joint project of the Supreme Court of the Republic of Uzbekistan, United States Agency for International Development (USAID) and United Nations Development Programme (UNDP). The primary goal of justice system is to ensure the protection of the constitutional rights, freedoms and legal interests of the citizens. Hence, citizens are the primary users of the court system, specifically, in the case with the civil courts. Given rapidly growing number of civil disputes and high workload of the civil courts, only efficient, transparent and accessible courts are able to guarantee the protection of the civil rights and interests of the citizens they serve. Therefore, today, it is crucial to set up a mechanism increasing transparency and accessibility of information about the courts, enhancing court responsiveness to citizen feedback, improving accessibility of justice for all layers of population, guaranteeing execution of court decisions, etc. It is empirical that such mechanism should include a complete cycle of preparation, data collection, including direct cooperation between judicial system and citizens (conduction of direct surveys on satisfaction), their handling and further usage for enhancement of judicial system and administration of courts. It should be noted, that establishing such mechanism is also in line with the provisions of Laws on “On transparency of the activities of the state authority and management bodies” and “On petitions of physical bodies and legal entities”, as well as Civil Procedural Code of the Republic of Uzbekistan. In order to do so, in collaboration with local consultants, Kathryn Harrison is going to study international best-practice methodologies of court performance evaluation, including administration of court user satisfaction surveys. In addition, an analysis of the existing legislative framework and objectives of the judicial reform will be conducted. “The main goal of my work is to study the existing court performance evaluation practice in Uzbekistan. But this is just a small part of my work. I am also going to study international experience in court performance evaluation, and come up with specific recommendations to improve the system, including suggestions on development of specific methodology. The goal is to develop a court performance evaluation system in collaboration with the Supreme Court of the Republic of Uzbekistan and its Research center. Currently, there is a certain evaluation framework, and specific criteria, for court performance evaluation, developed by the Supreme Court together with the Higher qualification commission on selection and appointment of judges under the President of the Republic of Uzbekistan and Supreme Economic Court. At the current stage, we need to develop specific mechanism to carry out such framework, answering such questions as how the evaluation will be conducted, what will be evaluated, what other questions and challenges can come up in the process, and the ways to resolve them”, says Kathryn Harrison. To study the experience of court performance assessment in Uzbekistan, Kathryn Harrison held meetings with the Supreme Court of the Republic of Uzbekistan and particularly Research Center of the Supreme Court, Higher Economic Court of Uzbekistan, Higher Qualification Commission for the Selection and Recommendation for the Position of Judges under the President of the Republic of Uzbekistan, Department on enforcement of court decisions, material and financial support of activities of courts under the Ministry of Justice of Uzbekistan, and Lawyers’ Training Center under the Ministry of Justice of Uzbekistan. *Kathryn Harrison possesses extensive experience leading teams of consultants in projects in the justice sector, following 18 years in executive positions in the judicial branch in California and management positions in the executive and legislative branches. Expertise includes creating effective management and planning structures; analyzing and recommending improvements in human resources, budgetary and information technology processes; developing strategic plans; and developing and delivering management training. Projects include World Bank- and USAID-funded projects in the Balkans (Serbia, Macedonia, Kosovo, Bosnia and Herzegovina, and Bulgaria), Romania, Armenia, Indonesia, and Nigeria.
